Pursuant to Article 13, Regulation (EU) 2016/679 (“GDPR”)
This information is provided, in addition to responding to a precise regulatory obligation, to clarify, in accordance with the principle of transparency, the areas of processing of your personal information regarding the submission of applications for collaboration with Auxilia S.r.l.
The Data Controller is Auxilia S.r.l. in the person of its legal representative pro tempore, with registered office in Rome, at Via della Farnesina, 73.
Your personal data consists of the information you have entered on your CV and concerns biographical data, contact details and information pertaining to your professional profile.
In any case, we urge you to release to us only the information that is necessary to evaluate your application and, above all, we ask you not to include at all special categories of data, already known as sensitive data (such as data on health or sexual life or sexual orientation or race or even data related to political, religious, trade union or philosophical beliefs or genetic or biometric data).
Where it considers such data to be essential, processing will be possible even without its consent where the processing is necessary to fulfill the obligations and exercise the specific rights of the data controller or data subject in the field of labor and social security law and social protection, where there is a legal basis and appropriate safeguards for the fundamental rights and interests of the data subject (e.g., membership in protected categories).
We also ask you not to include your image and where it is present we will immediately proceed to delete it.
You will, in any case, have the right to periodically send us your updated CV which will be replaced with the previous one by the Holder where the maximum retention period of one year has not yet expired. In the event that you are invited for an interview and the interview results in a lack of interest in hiring your CV will be deleted immediately after the interview.
The information is collected from you (i.e., by filling out the online form and attaching the CV).
Your data could be collected, where an interest in your position emerges as a result of the interview and only if the conditions of Opinion 2 of 2017 of the Group of Guarantors ex art 29 Dir 95/46/CE are met, also through third parties (e.g. open source sources to verify the veracity of the data included in your CV) where you are to hold particular positions in the company that also expose the holder in terms of corporate image (e.g., directors, attorneys, managers and other high professional profiles or positions where the fiduciary element is essential or even in the event that such activity is indicated in the job advertisement to which you have responded).
The legal basis for processing is pre-contractual requirements at the instance of the data subject, fulfillment of legal obligations and the legitimate interest of the data controller such as security purposes or defensive needs. There are no processing operations for which consent is required, and in the event that you enter data for which, on the other hand, consent is required we will immediately proceed to the deletion of such data, where such data cannot be deleted except by deleting the file we will proceed to the destruction of the entire document.
You can always object, on grounds related to your particular situation, to processing carried out for legitimate interests. In such a case, the data controller shall refrain from further processing of personal data unless he or she demonstrates the existence of compelling legitimate grounds for processing that override the interests, rights and freedoms of the data subject or for the establishment, exercise or defense of a legal claim.
For the purpose of carrying out the activities functional to the selection process and, if necessary, to the establishment and continuation of the contractual relationship to which you should be a party, Auxilia S.r.l. processes the following types of Data, on the basis of Art. 6 par.1 lett. b) of the GDPR:
Auxilia may also process your Data in order to prevent, detect or prosecute, in its legitimate interest, unlawful conduct, abuse or fraud and, more generally, to enforce or defend in court in the appropriate forums.
The Data Controller may communicate, for operational and administrative needs, your personal data to Third Party Companies specifically appointed as Data Processors by the Data Controller. In addition, it may communicate your personal data to parties to whom the communication is due by virtue of legal obligations, to Public Administrations and other entities that will process your personal data as autonomous Data Controllers. In any case, the list of Data Controllers can be requested by contacting the Data Controller at the contact details indicated in this privacy policy. No form of dissemination of your Data to unspecified parties is envisaged.
Your data will not be subject to transfer outside Italy either to EU or non-EU countries. In particular, the Data Controller guarantees that non-EU transfers where they are to be made in the future will take place on the basis of an adequacy decision or the signing by the Data Controller of standard data protection contractual clauses approved by the European Commission. Your Data will be processed by Auxilia S.r.l., for the 12 months following the receipt of your curriculum vitae or application; after this period, your personal data will be permanently deleted unless you have sent a new CV, preferably updated to obtain a new evaluation.
You may at any time exercise your rights vis-à-vis the Data Controller, in accordance with Art. 15 et seq. of European Regulation No. 679/2016, such as the right of access, rectification, portability, restriction, cancellation and opposition if the legal requirements are met. You may assert your rights by sending a communication to the company’s headquarters, addressed to the Data Controller or by making use of the email address privacy@auxiliagroup.com. You may make use of the same email to contact the Data Protection Officer or Data Protection Officer appointed by the Data Controller. You may, also, view the updated list of Data Protection Officers by making a request to the Data Controller.
You may file a complaint, pursuant to Article 77 of the GDPR, if you believe there has been a breach of your personal data, before the Privacy Authority. SEE www.garanteprivacy.it.
